Design Terms and Conditions

Design questionnaire: After initial contact regarding website design, clients will complete and submit the design questionnaire. This questionnaire will help give the designer a concrete understanding of exactly what the client is looking for out of their design experience.

Process approval: Upon sign-up and completion of design questionnaire, clients will receive an email that explains the design process/steps involved and be asked to approve by email that they understand the process and design terms and conditions. This helps ensure clients know exactly what their package or work includes and what they can expect. Any additional clarification on the design questionnaire will be completed at this time.

Payment up-front: Payment in full up-front is required to secure a position in our design queue. When we receive payment we will notify clients of expected project commencement time and the timeline anticipated from project start to finish.

Refunds: Refunds are not available for designs, implementation services or tech support. However, under certain circumstances we may may issue a credit.

Contracts: Your contract is with your individual designer and not with Upsy Daisy Productions as a company.

Free lance designers: Upsy Daisy Productions reserves the right to assign design work to our free lance designers to ensure that the terms and conditions of this agreement are met and completed in a timely manner.

Image usage: Some images used in our site designs are obtained from free stock photo/imagery websites. Use of any non-licensed imagery is the SOLE RESPONSIBILITY OF THE CLIENT. If you provide non-licensed images to us for use in your design, the risk of liability for use of those images is assumed by the client.

Blog software: All blog designs assume the client has or will obtain/purchase proper licensing for blogging software. The prices listed for design work that includes blog software installs do NOT include any fee-based software that the client wants to use. If you provide non-licensed blog software to us for use in your design, the risk of liability for use of those images is assumed by the client.

File backups: While each designer keeps backups of their work, the client assumes responsibility for ALL files & templates in case of emergency. Please backup your files accordingly.

Changes: Should a client choose a mockup, make changes to it and then approve the design as ready for the coding process, the design phase of work is considered complete. The coding process will include smaller changes such as text (not text as images) changes (to color, sizing, font style, etc) and link styles. Should the client request changes that require a designer to revert back to the mock-up stage and start coding anew, it will be considered a new design and be re-charged the entire package rate. Once our designs have been uploaded and activated on the client's site, any changes made by the client that result in web page errors or design reconfiguration will be billed at an hourly rate of $25. We realize this may seem confusing. Please don't hesitate to contact us if you'd like further clarification of the change process and what it includes and excludes.

Photoblogs: Photoblogs do not include plugins to generate thumbnail images or any other plugins. It is the client's responsibility to purchase or obtain licensing for Photoblogging software. Designers retain the right to charge additional pricing on photoblogs should the work included exceed general layout, design and basic implementation. Plugins start at $10/plugin but do not include customization of plugin. Please contact us if you require more information on these exclusions.

Skinning: Site skinning requires PHP 4+. It is the client's responsibility to to make sure their host is running PHP 4+ before ordering any services that include skinning.

Link-back and credit: Any design, production, development or technical support that is provided by Upsy Daisy Productions requires a text link or button that links back to Upsy Daisy Productions.

Design project copyrights: Upsy Daisy Productions owns copyright to any finished web design that was created by Upsy Daisy Productions. Rights to graphics, photos, web source code, mock-up files and any designs will remain the property of their respective designers/owners. Upsy Daisy Productions and its free lance designers reserve the right to use any designs created by Upsy Daisy Productions in a portfolio or for self-promotion purposes.

Please be reasonable. All packages and design are subject to limitations, and are priced accordingly. They are priced solely for design work and not technical add-ins. While we strive to make the design process fun and exciting for our clients, we ask that respect for our time and livelihood is given.
